"Unknown To Any Civilised System": Supreme Court On 'Bulldozer Justice'

The full text of Chief Justice of India DY Chandrachud's recent judgment on illegal demolitions in Uttar Pradesh mentions "justice through bulldozers is unknown to any civilised system of jurisprudence."

The Supreme Court on Wednesday had pulled up the UP government for an "illegal" demolition in 2019 while issuing directions to all states and Union Territories (UT) on the procedure to be followed during road-widening and removal of encroachments.

A bench of Chief Justice Chandrachud and Justices JB Pardiwala and Manoj Misra had also directed the UP government to pay Rs 25 lakh compensation to the man whose house was razed in 2019 for a road-widening project.

"... There is a grave danger that if high-handed and unlawful behaviour is permitted by any wing or officer of the state, demolition of citizens' properties will take place as a selective reprisal for extraneous reasons," Chief Justice Chandracud said in the order.

"Citizens' voices cannot be throttled by a threat of destroying their properties and homesteads. The ultimate security which a human being possesses is to the homestead. The law does not undoubtedly condone unlawful occupation of public property and encroachments," he said.

"Bulldozer justice is simply unacceptable under the rule of law. If it were to be permitted, the constitutional recognition of the right to property under Article 300A would be reduced to a dead letter," the Supreme Court said.

The Supreme Court had then directed the UP chief secretary to conduct an inquiry into the matter pertaining to a house in Maharajganj district and take suitable action. The bench elaborated on the steps that a state or its instrumentality must undertake before taking action in pursuance to a road-widening project.

In case an encroachment was found, the state must issue notice to the encroacher to remove it and if the correctness and validity of the notice was objected to, the state would issue a "speaking order" keeping in mind the principles of natural justice, the Supreme Court said.

In a scenario of the objection being rejected, a reasonable notice would be given to the person against whom the adverse action was proposed, to remove the encroachment, it added.

US Charges Iranian Man In Plot To Assassinate Donald Trump

The United States has charged an Iranian man in connection with an alleged plot ordered by Iran's elite Revolutionary Guards Corps to assassinate President-elect Donald Trump, the Justice Department said on Friday.

In a statement, the department said that Farhad Shakeri had informed law enforcement "that he was tasked on October 7, 2024, with providing a plan to kill" Trump, the department said. Shakeri allegedly told law enforcement he had no plans to formulate a plan to kill Trump within the IRGC's timeline.

The department described Shakeri, 51, as an IRGC asset residing in Tehran. It said he immigrated to the US as a child and was deported in or about 2008 following a robbery conviction. Shakeri is at large and believed to be in Iran, the prosecutors said.

Two New York residents whom Shakeri had met in prison, Carlisle Rivera and Jonathan Loadholt, have also been charged for helping Shakeri plot to kill a US citizen of Iranian origin in New York, described as an outspoken critic of Iran's government who had previously been targeted for murder.

Prosecutors did not identify the target, but it matched the description of Masih Alinejad, a journalist and activist who has criticized Iran's head-covering laws for women. Four Iranians were charged in 2021 in connection with a plot to kidnap her, and in 2022 a man was arrested with a rifle outside her home.

Rivera and Loadholt have both been ordered detained pending trial. Their lawyers did not immediately respond to requests for comment.

Yoga Teacher Buried Alive, Escapes Death Using Breathing Techniques

A 34-year-old Yoga teacher faked her death using breathing techniques and saved herself after allegedly being assaulted, strangled and then buried by a group of people who assumed she was dead, police said on Friday.

Five people, including a woman identified as Bindu and her friend named Satish Reddy who runs a detective agency in Bengaluru, have been arrested in connection with the incident, they said.

"Bindu suspected her husband of having an affair with the Yoga teacher and asked Reddy to keep a tab on the woman and her proximity to him. As part of the plan, Reddy allegedly befriended the victim some three months ago on the pretext of taking Yoga classes from her and during this period, he managed to gain her confidence," a police official said.

In her complaint, the victim alleged that on the pretext of showing some places around the city on October 23, he came to her house near Dibburahalli and took her in a car in which three other men were also present.

She alleged that they took her to a secluded spot on the outskirts of the city and allegedly stripped and assaulted her.

According to her, she was thrashed, threatened and strangled using a cable. She claimed that she played along, pretended to be unconscious and faked her death using breathing techniques.

"Assuming the woman died, the accused allegedly dug a pit and covered her body with thin layers of soil because they were in a hurry and feared to be caught. But before leaving, they took away all her gold jewellery," a senior police officer said.

She claimed that she later managed to wriggle out of the pit and with the help of some villagers, got clothes and managed to reach the police station to file a complaint, he said.

The woman was sent for a medical examination as per procedure and admitted to a hospital.

"Based on the complaint, we registered a case under sections of kidnapping, attempt to murder and other appropriate sections of the Bharatiya Nyaya Sanhita. Based on the investigation, we arrested five people, including Reddy and Bindu, on November 6," the officer said.

The vehicle in which the victim was kidnapped was allegedly stolen from Bengaluru, police said, adding, the victim's jewellery has also been recovered with the arrests.

"We are trying to verify all the claims made by the victim. There were also some online money transactions between Bindu and the associates and we are investigating the money trail also," he added.

Dhruv Jurel showcased his sound technique and cool temperament while wickets fell like ninepins at the other end in another shoddy batting display by India A on the opening day of the second unofficial Test against Australia A at the iconic MCG on Thursday. Jurel (80 off 186 balls), who came to bat in the third over scored nearly half of India A's paltry first innings total of 161 in 57.1 overs with only other batter to cross 20-run mark was Devdutt Padikkal (26).

Veteran KL Rahul (4), opening the batting, done in by a peach of a delivery from Scott Boland (1/51 in 15 overs).

Michael Neser (4/27 in 12.2 overs), one of the finest and unluckiest among contemporary Australian pacers, dealt a telling blow in the opening over from which India A couldn't recover.

BharatMatrimony Reacts To Married Woman's Viral 'Fake Profile' Claim

BharatMatrimony founder and CEO Murugavel Janakiraman has responded after a married woman discovered her image on the matrimony platform without her permission. In a statement to NDTV, Mr Janakiraman clarified that the profile in question was mistakenly thought to be created on EliteMatrimony, BharatMatrimony's exclusive matchmaking service, when in fact, it originated on a different online platform within the BharatMatrimony network. 

Mr Janakiraman explained that BharatMatrimony allows third-party account creations, such as parents or family members creating profiles on behalf of their loved ones, a common practice that constitutes about 25% of their user base. Unfortunately, this practice can lead to occasional misuse of public images in fake profiles-a challenge the entire matchmaking industry faces. "This is an industry-wide issue, as there isn't a foolproof way to completely prevent it," he noted.

Reassuring users, Mr Janakiraman emphasized BharatMatrimony's commitment to safety, highlighting their robust verification processes amidst the six million new registrations they receive annually. He affirmed that only a minimal fraction of these accounts are found to be fraudulent. 

"Millions have found their life partners through us and consider our service a boon. We have always been a pioneer in the matchmaking industry, with immense trust and credibility, and we continue to evolve and make our platform more safe and secure," Mr Janakiraman said. 

The video of the incident was posted on Instagram by Swati Mukund who called the platform a "BharatMatrimony Scam" and warned others to be cautious while using it. In the clip, she clarified that she had never used any matrimonial app to meet her husband, featuring him in her video to dissuade any claims that BharatMatrimony facilitated their match. "More acrimony than matrimony, I guess!" she added, highlighting her frustration.

The viral video begins Ms Mukund addressing the issue, saying, "So, this is a post on India's number 1 and supposedly most trusted matrimonial app, BharatMatrimony." A screenshot from the app appears in the video, showing her photo along with the overlay words "BharatMatrimony Scam."

"As you can see, the picture used is of mine and for the record, this is my husband. No, I didn't find him on any of these apps," she clarified.

She was shocked after finding her picture was used in the app's elite subscription service, a feature that promises to carefully curate profiles for users paying a premium for the service.

"What really appalled me is the fact that this is BharatMatrimony's elite subscription service, where they are actually charging people pots of money and claim that they are screening and carefully curating profiles to make sure their users find the right life partner," Ms Mukund said.

Kamala Harris Dials Trump To Concede Presidential Election, Say Her Aides

US Vice President Kamala Harris called Donald Trump on Wednesday to congratulate him for winning the 2024 presidential election, one of her senior aides said, following a bitter and contentious race.

Democrat Harris discussed with Mr Trump the importance of a peaceful transfer of power and being a President for all Americans, said the aide, confirming that Ms Harris will deliver remarks in Washington later today.

During the acrimonious campaign, the Democratic presidential candidate had described Mr Trump as a unique threat to democracy, but her campaign in the end underwhelmed voters.

She will deliver her concession speech in Washington today (2.30 am IST).

Mr Trump had never conceded defeat four years ago when his supporters ransacked the US Capitol. He returned to the White House with wider margins than before despite a criminal conviction, two impeachments while last in office and warnings from his former chief of staff that he was a "fascist."

At 78, Mr Trump will be the oldest President during his inauguration scheduled on January 20. Had Ms Harris won, she would have been the first woman president of the US. "It's a political victory that our country has never seen before," Mr Trump said earlier today in his victory speech.

Global leaders swiftly pledged to work with Mr Trump, despite concerns in some parts of the world about his "America First" approach. Among the most worried countries will be Ukraine, which Russia invaded in 2022.

Prime Minister Narendra Modi was among the first leaders who dialled Mr Trump to congratulate him. "Had a great conversation with my friend, President Donald Trump, congratulating him on his spectacular victory. Looking forward to working closely together once again to further strengthen India-US relations across technology, defence, energy, space and several other sectors," PM Modi said in a post on X.

Mr Trump and Vice President-elect JD Vance have scoffed at the billions of dollars in US assistance to Ukraine under outgoing President Joe Biden, with their aides musing about forcing Ukraine to make concessions to end the war.

Ukrainian President Volodymyr Zelensky congratulated Trump and said he hoped the new US leader would help Ukraine find a "just peace."

Ms Harris entered the race in July after the visibly ageing Biden dropped out. She ran a centrist campaign that highlighted Mr Trump's inflammatory messaging and use of racist and sexist tropes. But his apocalyptic warnings about immigration found their mark with voters battered by the post-Covid economy and eager for change after the Biden years.

Hispanic and Black Americans, seen as crucial voting blocs for Harris, moved in greater numbers toward Mr Trump, who won a majority of Latino men, exit polls had shown.

Mr Trump is the first US President in more than a century to win a non-consecutive second term, and the only person to be elected President as a convicted felon -- he is scheduled to face sentencing in a New York court for fraud on November 26.

He is also a longtime sceptic of climate change who is expected again to reduce US global commitments, although one of his top campaign surrogates was fellow billionaire Elon Musk, owner of electric vehicle maker Tesla.
